1. Agreement

By downloading, accessing, or using the Foldmetry iOS or iPadOS application (the “App”), you agree to these Terms of Use and the Privacy Policy. These terms supplement the Apple Standard End User License Agreement (“Apple EULA”) that applies to App Store downloads. If you do not agree, do not use the App.

You must be legally able to agree to these terms. If you are under the age of majority where you live, a parent or legal guardian must approve your use and manage purchases.

2. What Foldmetry provides

Foldmetry provides on-device spatial-reasoning exercises including mental rotation, cube-net folding, perspective taking, paper folding, and block assembly. Features, question types, difficulty, availability, and presentation may change as the App improves.

The App is designed to work without a Foldmetry account or custom application server. Your progress is normally stored locally. You are responsible for your device, backups, Apple Account, and access credentials.

3. Educational-use disclaimer

The App is for general educational practice and entertainment. Exercises, scores, ratings, streaks, summaries, and recommendations are not standardized assessments and must not be treated as measures of intelligence, cognitive health, disability, fitness for a role, or professional capability.

Foldmetry does not provide medical, psychological, educational, legal, or employment advice; does not guarantee improvement or any exam outcome; and is not affiliated with or endorsed by an exam authority, school, employer, healthcare provider, or Apple. Do not use App output as the sole basis for a high-impact decision about yourself or another person.

4. License and acceptable use

Subject to these terms and the Apple EULA, you receive a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, subject to Apple’s platform and account rules.

You may not:

• copy, redistribute, sell, rent, sublicense, or commercially exploit the App or its question content except where law expressly permits;
• reverse engineer, bypass access controls, manipulate purchase verification, or attempt to obtain paid features without authorization, except to the extent a restriction is prohibited by law;
• use automated extraction to reproduce a substantial question bank or visual asset collection;
• interfere with the App, StoreKit, App Store review, or another person’s device or account; or
• use the App unlawfully or in a way that infringes intellectual-property, privacy, or other rights.

5. Free and Pro features

The App includes a meaningful free experience and may place limits on daily questions, difficulty, history, or advanced practice. Foldmetry Pro unlocks unlimited sessions, difficulty levels 4–10, selectable session lengths, and complete training history. The exact current entitlement is shown in the App before purchase.

We may improve, replace, add, or remove individual exercises and features. We will not knowingly remove an active paid entitlement merely to demand a duplicate purchase. Some changes may be required for safety, law, platform compatibility, technical maintenance, or App Store policy.

6. Annual subscription

Payment is charged to your Apple Account at confirmation. Unless cancelled, the subscription automatically renews for another annual period. You can cancel in Apple Account subscription settings; cancellation should be made at least 24 hours before the current period ends to avoid renewal. Apple may charge the account within 24 hours before the end of the current period. A cancellation stops future renewal but normally leaves Pro available until the paid period ends. Deleting the App does not cancel a subscription.

If you begin an eligible trial, it converts to a paid annual subscription unless cancelled before the trial ends. Any applicable unused portion of a trial may be forfeited when a subscription is purchased, as described by Apple. Trial, billing-retry, grace-period, refund, and renewal behavior is controlled by Apple and applicable law.

7. Lifetime purchase

“Lifetime” means the non-consumable Pro entitlement for this App can be restored through the purchasing Apple Account while Foldmetry remains distributed and compatible with supported Apple platforms. It does not promise that every device, operating-system version, or App Store service will be supported forever, or that every future product from the developer is included.

8. Purchases, restoration, and refunds

All purchases are processed by Apple, not directly by Foldmetry. Product availability, storefront pricing, taxes, payment methods, eligibility, and refund decisions are governed by Apple and local law. Family Sharing is not enabled for either Foldmetry Pro product in version 1.0.

Use “Restore Purchases” in the App with the Apple Account that made the purchase. If restoration does not work, see Support. Refund requests must generally be submitted to Apple at reportaproblem.apple.com; Foldmetry cannot issue an App Store refund or view full payment details.

9. Local data and device changes

Foldmetry does not provide cloud sync or a developer account in version 1.0. Progress and settings may be lost if you reset them, delete the App, replace or erase a device, restore an incompatible backup, or encounter device/storage failure. A StoreKit purchase may be restorable, but local scores and history are separate from the purchase entitlement. Foldmetry is not responsible for local-data loss beyond rights that cannot legally be excluded.

10. Intellectual property and feedback

The App, brand, software, generated-question systems, visual design, text, and included assets are owned by Foldmetry or its licensors and are protected by applicable law. Apple and its product names are trademarks of Apple Inc. No ownership right is transferred to you.

If you voluntarily send ideas or feedback, you allow us to use them to improve Foldmetry without payment or confidentiality obligation, provided we do not claim ownership of your pre-existing intellectual property.

11. Availability, updates, and termination

We aim to maintain a useful App but do not promise uninterrupted, error-free, or perpetual availability. App Store, StoreKit, device, and operating-system changes are outside our control. Updates may be necessary for compatibility, security, law, or continued functionality.

You may stop using the App at any time; removing it does not automatically cancel a subscription. We may suspend access or discontinue distribution where reasonably necessary, including for unlawful use, security, legal obligations, or platform requirements. Provisions that logically survive termination—including ownership, disclaimers, and liability limits—continue to apply.

12. Disclaimers and limitation of liability

To the maximum extent permitted by law, the App is provided “as is” and “as available,” without warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, or guaranteed results. Procedurally generated questions may contain errors or ambiguity; please report suspected issues rather than relying on them for a consequential decision.

To the maximum extent permitted by law, Foldmetry will not be liable for indirect, incidental, special, consequential, or punitive loss; loss of data, opportunity, profits, or expected results; or harm arising from reliance on exercise output, device failure, or third-party services. Where liability cannot be excluded, it is limited to the greater of the amount you paid for the App during the 12 months before the claim or the minimum amount required by law.

Nothing in these terms excludes a warranty, remedy, or consumer right that applicable law does not allow us to exclude or limit. In that case, these terms apply only to the greatest extent permitted.

13. Apple

Apple is not responsible for the App or its content, maintenance, support, or claims, except for obligations Apple expressly accepts under its own terms or applicable law. Apple and its subsidiaries are intended third-party beneficiaries of these terms and may enforce the relevant provisions. If these terms conflict with the Apple Media Services Terms or Apple EULA for an App Store transaction, Apple’s applicable terms control that transaction.

14. Changes and applicable law

We may update these terms for new features, legal requirements, platform rules, or clearer wording. Material changes will receive a new effective date and appropriate notice. Continued use after a change takes effect means acceptance where permitted by law; where consent is legally required, we will request it.

Mandatory consumer laws and courts available in your place of residence remain unaffected. Otherwise, applicable law and forum are those of the developer’s legal domicile as shown by the App Store seller record, without applying conflict-of-law rules to defeat mandatory local rights.
